1. Acceptance of Terms

By accessing or using the CreativeHub website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our website or services.

2. Services Provided

CreativeHub offers website development, design, maintenance, and related digital services. Specific deliverables, timelines, and pricing will be outlined in individual project proposals or agreements signed by both parties.

3. Client Responsibilities

You agree to:

  • Provide accurate, complete, and timely information, content, and feedback required for project completion.
  • Cooperate with our team during the discovery, design, development, and testing phases.
  • Obtain all necessary permissions, licenses, or approvals for any third-party materials you provide.
  • Notify us immediately of any changes to your contact information or project requirements.

Delays caused by the client may result in extended delivery timelines. CreativeHub is not liable for any losses arising from client-caused delays.

4. Project Timeline & Delivery

Estimated timelines are provided in proposals. While we strive to meet all deadlines, delivery dates are approximate and not guaranteed. We will notify you promptly of any anticipated delays. A project is considered delivered when the website is uploaded to a staging or live server and made available for your review.

5. Payments

Payment schedules are defined in each proposal. Typically, we require:

  • Advance Payment: 50% of the total project fee before work begins.
  • Final Payment: 50% upon project completion and before final delivery or launch.

All payments are non-refundable after work has commenced, except as described in the Refund Policy below. Invoices are payable within 7 days of receipt unless otherwise agreed.

6. Refund Policy (Detailed)

We want you to be fully satisfied. However, because custom digital services involve significant time and effort, refunds are provided only in the following circumstances:

6.1 When Refunds Are Applicable
  • Before work begins: If you cancel the project within 24 hours of making the advance payment and no work has been started, you will receive a 100% refund.
  • Material failure to meet specifications: If we fail to deliver the core functionality as described in the proposal, and we cannot fix the issue within the stipulated timeframe following your written notice, you may request a partial refund proportional to the incomplete work.
  • Technical impossibility: If a required feature turns out to be technically impossible to implement (despite our expertise) and no alternative solution is acceptable, you may cancel and receive a refund for that portion of the work not yet performed.
  • Mutual agreement: We may, at our discretion, offer partial refunds for other valid reasons you present.
6.2 When Refunds Are NOT Applicable
  • If you change your mind after work has begun (including design, coding, or content setup).
  • If you fail to provide required feedback, content, or approvals for more than 15 business days, causing project abandonment.
  • If you request additional features beyond the original scope and then cancel because of cost or timeline changes.
  • If you are dissatisfied with design aesthetics after already approving the design mockups in writing.
  • If the project is delayed due to your actions or inactions.
6.3 Refund Process

To request a refund, you must send a written notice via email to hello@creativehub.com explaining the reason. We will respond within 5 business days. If approved, refunds will be processed within 14 days using the original payment method. Any processing fees charged by payment gateways will be deducted.

6.4 Our Commitment

We believe in fair business practices. If you are unhappy with our work for a legitimate reason not covered above, please contact us. We will try to resolve the issue through revisions or partial compensation before resorting to refunds.

7. Intellectual Property Rights

Upon full and final payment: All ownership rights to the custom-coded website (excluding third-party plugins, fonts, or stock assets) are transferred to you. We retain the right to display the project in our portfolio, including screenshots and a link, unless you request otherwise in writing.

Any code, concepts, or materials not paid for remain our property. You may not reuse or redistribute our proprietary tools or templates without a separate license.

8. Limitation of Liability

To the maximum extent permitted by law, CreativeHub and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising from your use of our services or website. Our total liability shall not exceed the total amount paid by you for the specific project in question.

9. Warranties & Disclaimer

We warrant that our services will be performed in a professional manner consistent with industry standards. However, we do not warrant that the website will be error‑free, uninterrupted, or fully secure. You are responsible for maintaining backups of your content.

10. Governing Law & Dispute Resolution

These terms are governed by the laws of India. Any dispute arising out of or relating to these terms or our services shall first be attempted to be resolved through good‑faith negotiation. If unresolved, the dispute shall be submitted to the exclusive jurisdiction of the courts in Saharanpur, Uttar Pradesh, India.

11. Changes to These Terms

We may update these Terms of Service from time to time. The latest version will always be posted on this page with the “Last updated” date. Your continued use of the site after changes constitutes acceptance of the revised terms.
